Terms of Service
This Terms of Service Agreement (the “Terms”, “TOS”, or “Agreement”) is a binding contract between you (“User”, “Member”, “Player”, or “You”) and Gaia RP (“Gaia RP”, “Services”, “We”, “Us”, or “Our”). This Agreement governs your access to and use of our website (https://www.gaiarp.com/), modded Ark server content, community Discord server, other media, and any other properties (whether physical or digital) owned or operated by Gaia RP. Additional services provided by Gaia RP may be subject to separate terms and conditions.
I. User Accounts
1. Naming Conventions
- Users must create a unique “Character Name” to represent themselves on the server. The use of another person’s name, third-party intellectual property, names that may mislead others into believing you are a Gaia RP staff member, or any name deemed vulgar, offensive, or otherwise inappropriate by Gaia RP, is strictly prohibited. Gaia RP reserves the right to refuse, alter, or delete any user name at its discretion.
2. Account Security
- Users are responsible for maintaining the security of their accounts and are solely liable for all activities that occur under their username. Gaia RP may restrict, suspend, or terminate access to services if account misuse is detected. Users must notify Gaia RP immediately if they suspect any breach of security, including loss or theft of account details. While Gaia RP takes steps to secure its services, it cannot guarantee complete security, and users are urged to take precautions to protect their personal data.
3. Multiple Accounts & Account Sharing
- Each user is limited to one (1) Gaia RP whitelisting. Users found with multiple accounts or engaging in account-sharing to exploit or abuse the system will have their membership and access to all services terminated.
II. Use of Services
1. Access to the Services
- Accessing Gaia RP services requires a personal computer and communication equipment such as a functional microphone and headphones. Users must provide their own equipment, including internet connections, to use Gaia RP Services.
2. Availability of Services
- Gaia RP does not guarantee that services will always be available or accessible. Services may be modified, updated, or discontinued at any time without notice. Gaia RP assumes no liability for lost or deleted account data and reserves the right to change or discontinue services at its sole discretion.
3. Monitoring of Services
- Gaia RP is not obligated to monitor or record online activities but reserves the right to do so. Users should not expect privacy in their communications while using Gaia RP Services.
4. Use of Services by Minors
- By using Gaia RP Services, you affirm that you are at least 16 years of age and legally permitted to access and use the services in your country. If you do not meet these criteria, do not use Gaia RP Services.
III. User Content
1. User-Generated Content
- “User Content” includes all activities on Gaia RP game servers and any posts, chats, images, videos, music, or other data submitted by users. Users are solely responsible for their content and may face consequences if their content violates these Terms. Gaia RP does not endorse, approve, or vouch for user-generated content and declines responsibility for any offensive, indecent, or objectionable content.
2. License Granted on User Content
- By using Gaia RP Services, users grant Gaia RP a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, modify, adapt, publicly display, reproduce, create derivative works from, transfer, sublicense, and distribute their content.
3. Code of Conduct
- Users must adhere to the Community Code of Conduct and Server Rules. Prohibited content includes but is not limited to offensive, unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or pornographic material. Harassment, real-world threats, impersonation, sharing personal information, disruption, cheating, and malicious behavior are strictly prohibited.
IV. Sale of Virtual Goods or Services
1. Prohibited Transactions
- Users may not solicit real currency, gifts, or favors for in-game items, currency, favors, or services. This includes but is not limited to trading in-game assets for real-world compensation, soliciting whitelist recommendations, or seeking special permissions.
V. Termination
1. Suspension or Termination of Account
- Gaia RP may issue warnings, restrict access, or permanently ban accounts in response to TOS violations. Gaia RP may terminate or suspend access without notice for reasons including but not limited to TOS violations, false information, infringement of intellectual property, or inactivity.
2. Consequences of Termination
- All associated data, content, and in-game assets will be forfeit upon account suspension, cancellation, closure, or termination. Users acknowledge the risk of account termination and agree to conduct themselves appropriately.
